IN THE EVENT WE REASONABLY DETERMINE THAT ANY ORDER OR ATTEMPTED ORDER WAS MADE BY OR THROUGH USE OF ANY ROBOT OR OTHER AUTOMATIC DEVICE OR SOFTWARE, WE HAVE THE RIGHT, IN OUR SOLE AND ABSOLUTE DISCRETION, TO DENY OR CANCEL ANY SUCH ORDER, TO REFUSE TO ACCEPT ANY RETURNS OR OFFER REFUNDS, AND/OR TO CHARGE RESTOCKING FEES.
BY USING THE SERVICES, YOU AGREE TO ARBITRATE DISPUTES AGAINST The Canadian Military Police Association (CMPA) Kit shop IN YOUR INDIVIDUAL CAPACITY IN ACCORDANCE WITH THE “Arbitration; Class Action Waiver; Jury Trial Waiver; Enforcement of Terms and Conditions; Governing Law” SECTION BELOW AND YOU ARE WAIVING YOUR RIGHT TO ACT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

The Canadian Military Police Association (CMPA) Kit shop reserves the right, at any time and without notice, to add to, change, update, or modify these Terms and Conditions simply by posting such addition, change, update, or modification on the Services. Pricing and Payment
The price for all goods will be as quoted on the Services. The prices displayed on the Services are quoted in Canadian dollars. Prices and availability information are subject to change without notice. Prices do not include sales tax, where applicable, or delivery costs, both of which you agree to pay upon ordering.
Order Acceptance
All orders placed by you are subject to acceptance by The Canadian Military Police Association (CMPA) Kit shop and all items are subject to availability.
Acknowledgement of your order means that The Canadian Military Police Association (CMPA) Kit shop has received your order request; it does not mean that your order has been accepted or shipped, or that the price or availability of an item has been confirmed. The Canadian Military Police Association (CMPA) Kit shop may in its discretion require additional verification or information before accepting any order.
The Canadian Military Police Association (CMPA) Kit shop reserves the right, without prior notice and in its sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include, but are not limited to: invalid, incomplete, improper, or missing payment or shipping information; limitations on quantities available for purchase; inaccuracies or errors in product or pricing information; use of any robot, spider or other automatic device, software, process or application to place, or take preparatory steps to place, one or more orders; violation of these Terms and Conditions; or actual or suspected fraud or abuse.
The Canadian Military Police Association (CMPA) Kit shop will verify the availability and price of an item before it is shipped. If an item's correct price is lower than the stated price, The Canadian Military Police Association (CMPA) Kit shop will charge the lower amount and ship you the item. If an item's correct price is higher than the stated price, if the item is no longer available, or if The Canadian Military Police Association (CMPA) Kit shop determines that there were inaccuracies in the product information, The Canadian Military Police Association (CMPA) Kit shop may cancel your order and notify you of such cancellation via email.
Risk of Loss
All purchases through the Services are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon The Canadian Military Police Association (CMPA) Kit shop’s delivery of such items to the shipping carrier. Except as expressly set forth in these Terms and Conditions, you are responsible for filing any claims with the applicable carrier for damaged and/or lost shipments.
Shipping and Returns/Exchanges
Shipping. Once an order is placed it cannot be cancelled once it has been shipped. Once the order is received, you can send the item back by following the instructions in our returns section here.
For domestic orders, please allow between 2-5 business days for order processing and verification. For international orders, please allow at least 5-7 business days for order processing and verification.
To protect our customers, The Canadian Military Police Association (CMPA) Kit shop is unable to change/intercept the shipping address of a package to alter its delivery, and The Canadian Military Police Association (CMPA) Kit shop will only ship to the address provided at checkout, the billing address must match the address associated with the method of payment.
Due to our Fraud Protection Policy, all online orders are required to have identical billing and shipping addresses. To minimize any fraudulent transactions, any orders with different shipping and billing addresses will be verified before being processed.
We are unable to combine shipping on multiple orders.
Lost or Stolen Package
As noted above, The Canadian Military Police Association (CMPA) Kit shop is not responsible for any lost or stolen shipments. However, if your package does not arrive, please contact 811shipping@gmail.com to initiate a Canada Post Claim.
Return/Exchange Policy
Returning an Online Purchase
We want you to be happy with the item you ordered, but if something isn’t right, let us know. All exchanges or returns can be made within 30 days of purchase for unused and unworn merchandise. All items must be returned in their original packaging and unopened. If the product is defective or broken upon arrival, you have 30 days to return or exchange the item, which must be unworn and unused. Online Returns and exchanges may be returned to the “CMPA Kit shop” by mail (please see Returning By Mail for instructions). For returns, the Canadian Military Police Association (CMPA) Kit shop will refund full merchandise price and the original shipping the customer was charged if there is a problem with the product or the error is ours. For exchanges or returns where we are not at fault, original shipping is not refunded. If an item was purchased while on sale, it is the sale price that will be refunded, not the full price. For any returns due to our error, please contact the Kit Shop Shipper at 811shipping@gmail.com to receive direction on how to return the item(s). For items being returned that are not due to our error, the return shipping to The Canadian Military Police Association (CMPA) Kit shop is the customer’s responsibility – that cost will not be refunded.
Please Note: All clearance sale items are final. If an item was purchased before it went on sale, the difference is not refunded.
All online refunds will be processed through the Canadian Military Police Association (CMPA) Kit shop in the same form of credit card payment that was used for the order. Once your refund has been completed you will receive a confirmation email.
Returns by Mail:
Within Canada
Return items must be sent via prepaid Regular Parcel Post to our shipping location (Winchester). Insuring your return allows you to track your parcel with Canada Post. Please Note: We cannot accept CODs or courier deliveries. Also, if you are returning a defective item or an item sent in error, then contact our shipper at 811shipping@gmail.com for information on how to return the item(s).
From outside Canada
Ship goods prepaid, by insured ground shipping. To avoid unnecessary delays, please write “Canadian Goods returning” on the outside of the package. Please Note: Do not return items by UPS or other carriers, as duty and/or brokerage fees will be charged, and your return will be refused by the Canadian Military Police Association (CMPA) Kit shop.

Subject to these Terms and Conditions, you are hereby granted a personal, non-exclusive, revocable, non-transferrable license to use the Services and view the content, functionality, software, information, data, products, and materials contained, described, referenced, or available on the Services (collectively, “Materials”) for your personal and non-commercial purposes. (f) otherwise use the Services for any unlawful or abusive purposes, including, but not limited to, the violation of any intellectual property rights (whether belonging to The Canadian Military Police Association (CMPA) Kit shop, the Canadian Armed Forces or third parties) and the posting or distribution of any “harmful” or “malicious” code or programming devices (e.g., viruses, malware, ransomware, corrupted files, key locks, back doors, trap doors, timers or other disabling devices) or any other similar software or programs that may adversely affect the operation of the Services or any other software, hardware, network or other technology (collectively, “Malicious Code”).
FINALLY, DO NOT USE THE SERVICES WHILE OPERATING A MOTORIZED VEHICLE OR WALKING. SUCH USE MAY DISTRACT YOU; MAY CREATE A HAZARD FOR YOU OR OTHERS AND IS ILLEGAL IN MANY AREAS.
Proprietary Materials
All Services and Materials, any improvements or modifications to such Services and Materials, any derivative works based thereon, and the collection, arrangement, and assembly of all such Services and Materials, are, except as otherwise expressly stated herein, owned exclusively by The Canadian Military Police Association (CMPA) Kit shop, the Canadian Armed Forces or its licensors, and The Canadian Military Police Association (CMPA) Kit shop (and, as applicable, its licensors) reserve all rights therein. The contents of the Services and Materials are protected by Canadian, United States and worldwide copyright and intellectual property laws and treaty provisions. The trademarks, service marks, trade names, logos, and other identifiers used in or in connection with the Services and Materials are the proprietary service marks or trademarks of The Canadian Military Police Association (CMPA) Kit shop, the Canadian Armed Forces, its licensors, or third parties, and are protected in Canada, the United States and internationally. No copying, modification or use of any of these marks or identifiers may be made without the prior, written authorization of The Canadian Military Police Association (CMPA) Kit shop, the Canadian Armed Forces or its licensors (as applicable). Except as expressly set forth above, nothing in this Agreement shall be deemed to grant to you or any other individual or entity any license or right in or to any copyright, trademark, trade secret or other proprietary right, whether owned by The Canadian Military Police Association (CMPA) Kit shop, the Canadian Armed Forces, its licensors, or any other person.

THE SERVICES AND ALL MATERIALS ARE PROVIDED TO YOU ON AN "AS IS" AND “AS AVAILABLE” BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, (a) ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR TITLE; (b) ANY WARRANTY REGARDING THE AVAILABILITY, ACCURACY, RELIABILITY, OPERATION, USE, OR PERFORMANCE OF THE SERVICES OR MATERIALS; (c) ANY WARRANTY THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICES, MATERIALS, AND/OR THE SERVER(S) AND CONNECTIONS THAT MAKE THEM AVAILABLE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR MALICIOUS CODE; AND (d) ANY IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.

Limitations of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE CANADIAN MILITARY P0LICE ASSOCIATOIN (CMPA) KIT SHOP’S AGGREGATE LIABILITY UNDER THIS AGREEMENT, COMBINED WITH THAT OF THE CANADIAN MILITARY P0LICE ASSOCIATOIN (CMPA) KIT SHOP’S PARTNERS AND ITS AND THEIR THIRD PARTY PROVIDERS AND LICENSORS, WHETHER IN CONTRACT, TORT OR OTHERWISE, SHALL NOT EXCEED AN AMOUNT EQUAL TO THE TOTAL AMOUNTS YOU PAID TO US UNDER THIS AGREEMENT; PROVIDED, HOWEVER, THAT THE FOREGOING LIMITATION ON LIABILITY SHALL NOT APPLY WITH RESPECT TO ANY LIABILITY ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold The Canadian Military Police Association (CMPA) Kit shop, its partners, its licensors, and its and their affiliates, members, officers, directors, managers, partners, employees, consultants, temporary resources, agents, suppliers, providers, contractors, subcontractors, licensors, successors, transferees, and assignees harmless from and against any and all damages, liabilities, actions, causes of action, suits, claims, demands, losses, costs and expenses (including without limitation reasonable attorneys’ fees, disbursements and court costs, including any incurred in enforcement of this indemnification provision) arising from or in connection with (a) your use of the Services, or any Materials, content, information, or services contained, displayed, available or accessible on or from the Services; (b) your violation of these Terms and Conditions; (c) any Submission (as defined below) provided by you to The Canadian Military Police Association (CMPA) Kit shop; or (d) your violation of any rights of any third party.

Arbitration; Class Action Waiver; Jury Trial Waiver; Enforcement of Terms and Conditions; Governing Law
You acknowledge and agree that the terms contained in this Terms and Conditions are reasonable and necessary, and that your actual or threatened breach of this Terms and Conditions would give rise to irreparable harm to The Canadian Military Police Association (CMPA) Kit shop for which monetary damages would not constitute an adequate remedy and, in addition to any and all other rights that may be available in respect of such breach or threatened breach, will entitle The Canadian Military Police Association (CMPA) Kit shop to immediate injunctive and other equitable relief without any requirement to post bond.
These Terms and Conditions are governed and interpreted pursuant to the laws of the Province of Ontario in Canada, notwithstanding any principles of conflicts of law. The Canadian Military Police Association (CMPA) Kit shop makes no representation that Materials provided through the Services are applicable or appropriate for use in all locations. If you use the Services from other locations, you are responsible for compliance with applicable local laws. If you take legal action relating to these Terms and Conditions or your interactions with or relationship to The Canadian Military Police Association (CMPA) Kit shop that is not subject to arbitration as provided below, you agree to file such action only in the provincial and federal courts located in the Province of Ontario, Canada and waive any objection you may have to the venue or forum. Any controversy or claim between you and The Canadian Military Police Association (CMPA) Kit shop arising out of or relating to these Terms and Conditions, or breach thereof, including disputes with respect to whether the subject matter of any controversy or claim is within the scope of the Terms and Conditions, will be resolved by binding arbitration in the Province of Ontario in Canada.
Neither you nor The Canadian Military Police Association (CMPA) Kit shop will participate in a class action or class-wide arbitration for any claims covered by these Terms and Conditions. Any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated or representative action. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY RIGHT TO TRIAL BY JURY IN ANY ACTION, SUIT, CLAIM OR PROCEEDING BROUGHT TO ENFORCE, DEFEND, OR INTERPRET ANY RIGHTS OR REMEDIES ARISING HEREUNDER, RELATING TO OR IN CONNECTION WITH THESE TERMS AND CONDITIONS.
If any part of these Terms and Conditions is found to be unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of remaining provisions.
Assignment
You may not assign or otherwise transfer these Terms and Conditions or any rights or obligations hereunder, in whole or in part, and any such assignment in violation of this Agreement shall be null and void. The failure of The Canadian Military Police Association (CMPA) Kit shop to exercise or enforce any right or provision set forth herein shall not constitute a waiver of such right or provision. Limitations de responsabilité
DANS LA MESURE PERMISE PAR LA LOI APPLICABLE, NI LA BOUTIQUE DU MAGASIN DE FOURNIMENT DE L’ASSOCATION DE LA POLICE MILITAIRE CANADIENNE (ACPM) DE L’ARMÉE CANADIENNE, NI LES FORCES ARMÉES CANADIENNES, NI SES FOURNISSEURS OU CONCÉDANTS DE LICENCE TIERS OU LEURS TIERS NE SERONT TENUS RESPONSABLES ENVERS VOUS OU UN TIERS DE TOUT DOMMAGE DIRECT, INDIRECT, SPÉCIAL, ACCESSOIRE, EXEMPLAIRE, PUNITIF ET CONSÉCUTIF, MÊME SI LA BOUTIQUE DE TROUSSES DE P0LICE ASSOCIATOIN (CMPA) MILITAIRE CANADIENNE A ÉTÉ PRÉALABLEMENT INFORMÉE DE LA POSSIBILITÉ DE TELS DOMMAGES, QUE CE SOIT DANS LE CADRE D’UNE ACTION EN VERTU D’UN CONTRAT, D’UNE NÉGLIGENCE OU DE TOUTE AUTRE THÉORIE, DÉCOULANT DE OU EN RELATION AVEC L’UTILISATION, L’INCAPACITÉ D’UTILISER OU L’EXÉCUTION DES SERVICES, OU DE TOUT MATÉRIEL, PAGE OU CONTENU ACCESSIBLE VIA LES SERVICES, ET LA BOUTIQUE DU MAGASIN DE FOURNIMENT DE L’ASSOCATION DE LA POLICE MILITAIRE CANADIENNE (ACPM), LES FORCES ARMÉES CANADIENNES, SES PARTENAIRES OU L’UN DE SES FOURNISSEURS OU CONCÉDANTS DE LICENCE TIERS OU TIERS NE SERONT PAS RESPONSABLES DE TOUT DOMMAGE RÉSULTANT D’ERREURS, OMISSIONS, INTERRUPTIONS, SUPPRESSIONS DE FICHIERS, ERREURS, DÉFAUTS, RETARDS DE FONCTIONNEMENT OU DE TRANSMISSION, OU TOUT DÉFAUT D’EXÉCUTION, QU’IL SOIT OU NON CAUSÉ PAR DES ÉVÉNEMENTS ÉCHAPPANT À LEUR CONTRÔLE RAISONNABLE, Y COMPRIS, MAIS SANS S’Y LIMITER, DES CAS DE FORCE MAJEURE, UNE DÉFAILLANCE DE LA LIGNE DE COMMUNICATION, LE VOL, LA DESTRUCTION OU L’ACCÈS NON AUTORISÉ À NOS DOSSIERS, MATÉRIAUX OU SERVICES.
DANS LA MESURE PERMISE PAR LA LOI APPLICABLE, LA RESPONSABILITÉ GLOBALE DE LA BOUTIQUE DU MAGASIN DE FOURNIMENT DE L’ASSOCATION DE LA POLICE MILITAIRE CANADIENNE (ACPM) EN VERTU DE LA PRÉSENTE ENTENTE, COMBINÉE À CELLE DES PARTENAIRES DE LA BOUTIQUE DU MAGASIN DE FOURNIMENT DE L’ASSOCATION DE LA POLICE MILITAIRE CANADIENNE (ACPM)ET DE SES FOURNISSEURS ET CONCÉDANTS DE LICENCE TIERS, QU’ILS SOIENT CONTRACTUELS, DÉLICTUELS OU AUTRES, NE DÉPASSERA PAS UN MONTANT ÉGAL AU MONTANT TOTAL QUE VOUS NOUS AVEZ PAYÉ EN VERTU DE LA PRÉSENTE ENTENTE; À CONDITION, TOUTEFOIS, QUE LA LIMITATION DE RESPONSABILITÉ QUI PRÉCÈDE NE S’APPLIQUE PAS À L’ÉGARD DE TOUTE RESPONSABILITÉ DÉCOULANT D’UNE NÉGLIGENCE GRAVE OU D’UNE FAUTE INTENTIONNELLE.
Indemnisation
Dans la mesure permise par la loi applicable, vous acceptez d’indemniser et de tenir la boutique de fourniment de l’Association de la police militaire canadienne (ACPM) ses partenaires, ses concédants de licence et ses sociétés affiliées, membres, dirigeants, administrateurs, gestionnaires, partenaires, employés, consultants, ressources temporaires, agents, fournisseurs, fournisseurs, entrepreneurs, sous-traitants, concédants de licence, successeurs, cessionnaires et cessionnaires indemnes de tout dommage, les responsabilités, actions, causes d’action, poursuites, réclamations, demandes, pertes, coûts et dépenses (y compris, sans s’y limiter, les honoraires d’avocat raisonnables, les déboursés et les frais de justice, y compris tout ce qui est encouru dans l’application de cette disposition d’indemnisation) découlant de ou en relation avec (a) votre utilisation des services, ou tout matériel, contenu, information ou services contenus, affichés, disponibles ou accessibles sur ou à partir des Services; (b) votre violation des présentes conditions générales ; (c) toute soumission (telle que définie ci-dessous) fournie par vous à la boutique de trousses de l’Association de la police militaire canadienne (ACPM); ou (d) votre violation des droits d’un tiers.

Si une partie des présentes conditions générales est jugée illégale, nulle ou inapplicable, cette partie sera réputée divisible et n’affectera pas la validité et l’applicabilité des autres dispositions.

Les présentes modalités constituent l’intégralité de l’entente entre vous et la boutique de fourniment de l’Association de la police militaire canadienne (ACPM) en ce qui concerne l’objet des présentes et remplacent toutes les ententes, ententes et représentations antérieures ou contemporaines, qu’elles soient écrites, orales ou autres.
